Courts play a key role in deciding on public health controversies, but the legitimacy of judicial intervention remains highly controversial. In this article I suggest that we need to carefully distinguish between different reasons for persistent disagreement in the domain of public health. Adjudicating between public health controversies rooted in factual disagreements allows us to investigate more closely the epistemic capacities of the judicial process. While the critics typically point out the lack of appropriate expertise of judges—in particular with respect (...) to health and public health—we should not move too fast in inferring from this a generalized competence problem. This article offers four reasons for vindicating the importance of judicial intervention in factual disagreements: the relative independence of judges from the political establishment, the judicial commitment to evidence, the specific nature of judicial reasoning and an additional voice for the people in the policy-making process. One major objection to social rights is a failure of determining which precise social and economic claims should be granted rights status. The social rights debate has grappled with this ‘indeterminacy problem’ for quite some time, and a number of proposals have emerged aimed at fixing the content of these rights. In what follows I examine three distinct approaches to fleshing out the idea of a minimum threshold: social rights as the fulfilment of basic needs, social rights as the securing (...) of a minimally decent life and social rights as a requirement of citizenship. Each of these proposals progressively expands on what the minimum threshold of social rights requires and, conversely, what obligations they generate on part of the state. I will show that none of these approaches is entirely satisfactory and suggest that the social rights debate look elsewhere to determine its content. (shrink)

The present paper analyses the topic of scientific discovery and the problem of the existence of a logical framework involved in such endeavour. We inquire how several non-monotonic logic frameworks and other formalisms can account for such a task. In the same vein, we analyse some key aspects of the historical and theoretical debate surrounding scientific discovery, in particular, the context of discovery and context of justification context distinction. The judiciary is a key policy actor that is involved in deciding health rights and policy by intervening in the policy process through a variety of judicial mechanisms, yet the appropriate extent of its involvement remains contentious. Taking the competence objection seriously requires understanding it as an epistemic problem about how courts assess empirical and scientific evidence in order to competently adjudicate controversial health claims. This paper examines recent advances in social epistemology to develop insights for the epistemic competence of (...) the judiciary from a system‐oriented approach. I outline three epistemic features that set the judiciary and the judicial decision‐making process apart from other types of decision‐makers in health policy: the distribution of epistemic power, the epistemic authority of a justified believer, and the principle of disinterestedness. A basic income is typically defined as an individual’s entitlement to receive a regular payment as a right, independent of other sources of income, employment or willingness to work, or living situation. In this article, we examine what it means for the state to institute a right to basic income. The normative literature on basic income has developed numerous arguments in support of basic income as an inextricable component of a just social order, but there exists little analysis about basic (...) income within a jurisprudential or philosophical rights perspective. In our view, strong reasons of either a principled or a pragmatic nature in support of instituting a basic income scheme nevertheless often fall short of ascribing to basic income a distinctive Hohfeldian rights status. This article aims to partially redress this gap by examining two sets of questions. First, what are the implications – ethical and practical – of adopting basic income as a legal right as opposed to a mere policy? Second, we also enquire whether there should be such a right: what, if anything, is the ethical foundation that warrants granting basic income a distinctive legal rights status? This article suggests that any such foundation must be grounded in comparative evaluation and discusses several comparative strategies available to basic income advocates. The aim of this article is not to offer a definite argument in favor of a legal right to basic income, but to chart several lines of argument that a rights perspective might add to the contemporary discussion. Our paper addresses the problem of a two-fold approach to skeptical inferences in the context non-monotonic logics. We tackle the problem through the analysis of ambiguous theories, such as the Nixon Diamond, as instantiated in non-monotonic inheritance networks, and the notion of an extension. Our paper presents a detailed description of the inner mechanisms underlying both approaches to skeptical inference, i.e. direct and indirect skepticism, and how each information processing policy is applied to ambiguous networks like the Nixon Diamond. SummaryPedigree structures of 161 uncle/niece-aunt/nephew and 4420 first cousin consanguineous marriages registered during the 19th and 20th centuries in two large and very different Spanish regions have been analysed and their genetic consequences evaluated. The frequencies of the different pedigree subtypes within each degree of relationship were quite similar in both populations despite significant heterogeneity in inbreeding patterns. The mean X-linked inbreeding coefficient for each type of cousin mating was calculated and compared to that expected for autosomal genes. This paper proposes communities of practice (CoP) as a process to build moral resilience in healthcare settings. We introduce the starting point of moral distress that arises from ethical challenges when actions of the healthcare professional are constrained. We examine how situations such as the current COVID-19 pandemic can exponentially increase moral distress in healthcare professionals. Then, we explore how moral resilience can help cope with moral distress. We propose the term collective moral resilience to capture the shared capacity arising (...) from mutual engagement and dialogue in group settings, towards responding to individual moral distress and towards building an ethical practice environment. Finally, we look at CoPs in healthcare and explore how these group experiences can be used to build collective moral resilience. (shrink)

This paper focuses on an emergency basic income as a tool for avoiding financial insecurity during the time of pandemic. The authors argue that paying each resident a monthly cash amount for the duration of the crisis would serve to protect them from the economic fallout.They suggest three reasons why the EBI proposal is particularly well-suited to play an important role in a comprehensive public health response to COVID-19: it offers an immediate and agile response; it prioritizes the most vulnerable (...) in the affected population; and it promotes a solidaristic response to the pandemic crisis. In the present paper we analyze the approach that sustains that history´s study is useful for the political activities improvement. Nowadays it is considered that the historian must not elaborate his works thinking to achieve an influence on the politics. Nevertheless, during the XIX century and previously, has been a different approach. Our reflection focus on two conspicuous works of the nineteenth century about the historical discipline: Historik by Johann G. Droysen and On the use and abuse of history for (...) life by Friedrich Nietzsche. This article dives on the moral role given to the study of history, as well as dives on the causes, postulated by both thinkers, that explain why history leads to a personal overcoming. The Cynic moral and sociopolitical imprint on Stoic philosophy has frequently been overlooked in recent academic studies. However, the Cynic influence is palpable throughout the history of Stoicism. In this article, I recognise seven Cynic-Stoic conceptual continuities concerning the idea of virtue, or aretē, and five continuities concerning the morally ideal society. This article is mainly descriptive, as it serves a modest but theoretically vital purpose: to explain the interrelation(s) among these 12 Cynic–Stoic continuities, which will elucidate the strong cohesion (...) of each (moral/political) philosophical system. Ergo, I show how these 12 continuities strongly and simultaneously imply a Cynic-Stoic continuity in terms of the conceptions or appraisals of culture-tradition, epistemology, sexuality, money, law, religion and cosmopolitanism. BackgroundUmbilical cord banks are a central component, as umbilical cord tissue providers, in both medical treatment and scientific research with stem cells. But, whereas the creation of umbilical cord banks is seen as successful practice, it is perceived as a risky style of play by others. This article examines and discusses the ethical, medical and legal considerations that arise from the operation of umbilical cord banks in Mexico.DiscussionA number of experts have stated that the use of umbilical cord goes beyond (...) the mere utilization of human tissues for the purpose of treatment. This tissue is also used in research studies: genetic studies, studies to evaluate the effectiveness of new antibiotics, studies to identify new proteins, etc. Meanwhile, others claim that the law and other norms for the functioning of cord banks are not consistent and are poorly defined. Some of these critics point out that the confidentiality of donor information is handled differently in different places. The fact that private cord banks offer their services as "biological insurance" in order to obtain informed consent by promising the parents that the tissue that will be stored insures the health of their child in the future raises the issue of whether the consent is freely given or given under coercion. Another consideration that must be made in relation to privately owned cord banks has to do with the ownership of the stored umbilical cord.SummaryConflicts between moral principles and economic interests (non-moral principles) cause dilemmas in the clinical practice of umbilical cord blood storage and use especially in privately owned banks. This article presents a reflection and some of the guidelines that must be followed by umbilical cord banks in order to deal with these conflicts. This reflection is based on the fundamental notions of ethics and public health and seeks to be a contribution towards the improvement of umbilical cord banks' performance. (shrink)

However, this concept has not been sufficiently developed, neither in the area of moral philosophy nor in bioethics. For this reason, it is necessary to define and analyze the conceptual framework in which the notion of vulnerability has been developed within the scope of bioethics. Thus, the purpose of (...) this paper is to indicate how the concept of vulnerability in the field of bioethics has been developed and what the main problems that derive from this approach are. Secondly, the paper analyzes some of the main philosophical approaches that I consider should be articulated in the expansion of a critical bioethics approach focused on the notion of vulnerability. To address this issue, I analyze the reflections that we find in the work of Martha Fineman, emphasizing the main relevant aspects for bioethics. Finally, I highlight the main implications of a theory of vulnerability for bioethics. | : Le concept de vulnérabilité est au coeur des développements actuels de la bioéthique, non seulement en raison de sa nature analytique, mais aussi en raison de son potentiel critique. Lo que este estudio muestra es fruto de un contacto directo, a través de cuestionarios, con lo que los españoles piensan, con lo que ellos dicen que está bien o que está mal. No se trata, pues, de lo que ellos hacen ni si lo que hacen se corresponde con lo que dicen. Se trata de establecer en qué medida su percepción moral, sus juicios sobre lo que está bien o lo que está mal, depende de cómo son y de (...) las creencias y actitudes que tienen. El objetivo es poder llegar a determinar si hay tendencias generales que puedan detectarse cuando se cumplen ciertos supuestos que son la base de la psicología del desarrollo moral, y sirven a su vez para conseguir objetivos educativos. Para ello, se hace un seguimiento de factores asociados a la permisividad moral: el contexto social, la edad, el sexo y la religiosidad de los sujetos, en dos etapas muy relevantes para España: el posconcilio Vaticano II y la transición a la democracia. En ese momento de cambio profundo, se trata de saber qué prácticas entienden aceptables y cuales rechazables, cuáles admitidas y cuáles prohibidas. Por su actualidad, se destacan tres puntos: Primero, los jóvenes españoles consideran la violencia como la conducta menos permitida. Segundo, ¿por qué los jóvenes de 21-24 años son más permisivos con la violencia doméstica que sus compañeros más jóvenes de 18-20 años y de 15-17 años? El libro que nos ocupa es un texto compuesto por doce capítulos, cada uno escrito por un investigador distinto; todos los capítulos consisten en análisis filosóficos en torno a un tema eje indicado por el título: la dignidad. En esta reseña, realizaré una revisión cronológico-diacrónica del tratamiento de la dignidad por los doce investigadores, para otorgar una idea clara a los posibles lectores de en qué épocas se concentró cada una de las reflexiones. Dignidad: Perspectivas y aportaciones de la filosofía (...) moral y la filosofía política es un texto coordinado y editado por los investigadores Carmen Trueba Atienza y Sergio Pérez Cortés, profesores de la Universidad Autónoma Metropolitana Iztapalapa, poseedores de una amplia trayectoria en la investigación filosófica, en especial en el área de la filosofía griega antigua y en el área de la filosofía política y moral en general. Tal trayectoria les permitió reunir y escoger con esmero y pertinencia a escritos de especialistas provenientes de diversos países de América Latina: Argentina, Chile, Colombia, México y Perú. In order to improve the management of copyright in the Internet, known as Digital Rights Management, there is the need for a shared language for copyright representation. Current approaches are based on purely syntactic solutions, i.e. a grammar that defines a rights expression language. These languages are difficult to put into practise due to the lack of explicit semantics that facilitate its implementation. Moreover, they are simple from the legal point of view because they are intended just to model the (...) usage licenses granted by content providers to end-users. Thus, they ignore the copyright framework that lies behind and the whole value chain from creators to end-users. Our proposal is to use a semantic approach based on semantic web ontologies. We detail the development of a copyright ontology in order to put this approach into practice. It models the copyright core concepts for creation, rights and the basic kinds of actions that operate on content. Altogether, it allows building a copyright framework for the complete value chain. The set of actions operating on content are our smaller building blocks in order to cope with the complexity of copyright value chains and statements and, at the same time, guarantee a high level of interoperability and evolvability. The resulting copyright modelling framework is flexible and complete enough to model many copyright scenarios, not just those related to the economic exploitation of content. The ontology also includes moral rights, so it is possible to model this kind of situations as it is shown in the included example model for a withdrawal scenario. Finally, the ontology design and the selection of tools result in a straightforward implementation. Description Logic reasoners are used for license checking and retrieval. Rights are modelled as classes of actions, action patterns are modelled also as classes and the same is done for concrete actions. Then, to check if some right or license grants an action is reduced to check for class subsumption, which is a direct functionality of these reasoners. (shrink)

The influence of age and formal education on the development of moral reasoning in a Spanish sample of students was assessed by using a Spanish translation of Rest's Defining Issues Test. Our results support the hypothesis that moral development is highly related to both variables in our cultural context, although more so with formal education than with age.

La autoestima proporciona al individuo un sentido de su propia (...) valía y le asegura la confianza necesaria para emprender y desarrollar un proyecto de vida significativo. Introduction Hospital delirium is a frequent, serious, costly, and underrecognized acute disorder of attention and cognition. Therefore, the prevention of hospital delirium is not only desirable for patients, caregivers, healthcare professionals, and the health system itself, but also a moral duty. Objective To identify and synthetize the main ethical aspects that arise related to the prevention of hospital delirium in patients 65 years and older. Methods A scoping review was carried out in Embase, Medline, and Web of Science. Articles published (...) in English or Spanish analyzing any pharmacologic, non-pharmacologic, or multicomponent intervention for prevention of delirium in hospitalized patients aged 65 years and over were included. Results Twenty-seven studies were included. Based on the frequency of appearance and the relevance, our findings were organized into three main areas. The first one was related to the principle of nonmaleficence and collected findings about the iatrogenic causes of hospital delirium and the use of restraints systems. The second area analyzed the impact of delirium in patients, families, and healthcare professionals from a relational ethics perspective, and addressed the family presence as a factor to prevent delirium. Finally, the third area is related to the quality of care. Conclusion Prevention of delirium in hospitals is essential to avoid the discomfort and potential clinical complications of patients, as well as the suffering of their relatives, caregivers, and healthcare professionals. Policymakers and healthcare managers are encouraged to make the required efforts to prevent delirium in hospitalized older patients. (shrink)

Uno de los problemas planteados en la historia desarrollada de los protagonistas de La ciudad y los perros (1963), del escritor peruano Mario Vargas Llosa, es la presencia de una formación familiar mal constituida (padres agresivos, distanciamiento de cualquiera de ellos, favoritismo materno hacia el hijo, etc.). Esta base retrógrada provocó una limitación para cada uno de ellos: sus conductas no son corregidas, tienen comportamientos rebeldes o inhibidos, se sienten incapaces de afrontar la realidad con responsabilidad y terminan incluyéndose en (...) el mecanismo dinámico de la violencia, ya sea como víctima o victimario. Para ello, se recurrirá al análisis literario, para abordar las conductas vinculadas con los personajes que poseen rasgos de violencia en su representación. Principalmente, las propuestas teóricas de Jacques Lacan, Slavoj Žižek y Mijaíl Bajtín revelan qué se entiende en la actualidad por practicar el bien en nuestra sociedad. Background: Despite the reported harms and ethical concerns about physical restraint use in the critical care settings, nurses’ intention to apply them is unequal across countries. According to the theory of planned behaviour, eliciting nurses’ beliefs regarding the use of physical restraints would provide additional social information about nurses’ intention to perform this practice. Aim: To explore the salient behavioural, normative and control beliefs underlying the intention of critical care nurses to use physical restraints from the theory of planned behaviour. (...) Research design: A belief elicitation study was conducted. Participants and research context: Twenty-six critical care nurses were purposively sampled across gender, work-shift patterns and professional experience in five intensive care units of three hospitals in Spain. Data were obtained from a nine-item open-ended questionnaire and a focus group. Deductive content analysis was performed. Ethical considerations: Ethical approval was obtained from the hospital ethics committee. Participants were assured their participation was voluntary. Findings: Nurses framed the use of restraints as a way of prioritising patients’ physical safety. They referred to contextual factors as the main reasons to justify their application. Nurses perceived that their decision is approved by other colleagues and the patients’ relatives. Some nurses started advocating against their use, but felt powerless to change this unsafe practice within an unfavourable climate. Control beliefs were linked to patients’ medical condition, availability of alternative solutions, analgo-sedation policies and work organisation. Discussion: Safety arguments based on the surrounding work environment were discussed. Conclusion: Nurses’ behavioural and control beliefs were related. Nurses should be trained in alternatives to physical restraint use. The impact of analgo-sedation protocols, relatives’ involvement, leadership support and intensive care unit restraint policies on physical restraint practices need to be revised. Levinas cree haber demostrado que sólo desde la experiencia ética, entendida como responsabilidad por el Otro, adviene lo humano al ser y a la vida. Este ensayo postula que la noción de dignidad humana formulada filosófica y moralmente desde la civilización occidental moderna, demanda hoy una re-lectura de sentido, a la luz de las perplejidades que anidan en la disonancia entre los principios morales y el derecho legal justiciable de los Derechos Humanos en las democracias contemporáneas. Si bien, la noción de Derechos Humanos deriva de la pertenencia a la familia humana en la que se asienta idealmente la universalidad de sus titulares y por (...) el principio de autonomía, el resultado de esta mixtura tiene su traducción en dos concepciones problemáticas: una abstracta del ser humano sobre la que se instrumenta una supuesta universalidad que derivó en otra individualista que convierte a los hombres en sujetos aislados y egoístas. Identificar el núcleo de esta perplejidad en Platón, Aristóteles y Benhabib, constituye el propósito de esta reflexión. (shrink)
